Either term used means that the driver was driving impaired. you can be tested and if your test reads back at 0.08% or higher you are automatically considered an impaired driver. First time offenders will be charged with a misdemeanor and will be given other punishments to follow. One of those could be to attend a DUI or Defensive Driving Course.
